Important
The Service is a device-finding aid, not an emergency, safety, security, or law-enforcement service. It cannot guarantee that a device will be found or recovered. Use it only for devices and accounts you own or are legally authorized to locate.
1. Agreement and provider
These Terms of Use ("Terms") govern your use of Find My: Phone, Watch, Earbuds (package
com.ua.makeev.antitheft), its Wear OS companion, and the related web portal (the "Service"). The Service is provided by MakeevApps s.r.o., IČO 24428582, DIČ CZ24428582, Kaprova 42/14, 110 00 Praha 1, Czech Republic ("MakeevApps", "we", "us", or "our"). Older versions or screens may use the shortened names "Find My Phone" or "Find Device".
By installing, accessing, purchasing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service. These Terms do not limit rights that applicable consumer law does not allow you to waive.
2. Eligibility
You must be at least 13 and legally capable of entering this agreement. If you have not reached the age of legal majority or digital consent in your country, a parent or legal guardian must review and accept these Terms and supervise your use. You may not use the Service if applicable law prohibits you from receiving it.
3. Limited license
Subject to these Terms, MakeevApps grants you a limited, personal, revocable, non-exclusive, non-transferable, and non-sublicensable license to install and use the app and Wear OS companion on compatible devices that you own or control, and to access the web portal, solely for lawful personal use. You receive a license, not ownership of the Service or its source code.
4. Acceptable use
You agree that you will:
- locate only devices, accounts, or property that you own or are legally authorized to locate;
- obtain any consent required before enabling location or monitoring features on a device used by another person;
- comply with privacy, stalking, surveillance, employment, family, and criminal laws that apply to you;
- not use the Service for stalking, harassment, coercive control, covert monitoring, theft, or any other unlawful or harmful purpose;
- not bypass access controls, probe or disrupt the Service, introduce malware, overload infrastructure, or access another user's account or data;
- not copy, modify, distribute, sell, lease, sublicense, reverse engineer, decompile, or attempt to extract source code except where applicable law expressly permits it;
- not falsely claim affiliation with MakeevApps or use the Service to infringe intellectual-property or other rights.
5. Accounts and security
You are responsible for accurate account information, safeguarding credentials, protecting access to your email or Google Account and devices, and activity under your Service account. MakeevApps does not receive or store your Google password. Notify us promptly at find.phone.app@gmail.com if you suspect unauthorized access to your Find My account or personal data processed through the Service. Issues relating solely to your Google Account should be directed to Google. We may require reauthentication or reasonable verification before allowing sensitive account actions.
Anonymous use may offer fewer recovery and synchronization options. You are responsible for configuring the Service before a device is lost and for keeping compatible permissions, connectivity, and background operation enabled.
6. Device-finding limitations and safety
Do not rely on the Service for emergencies, personal safety, medical needs, theft prevention, or law-enforcement response.
Location and proximity results may be delayed, incomplete, stale, or inaccurate. Operation depends on factors outside our control, including prior installation and configuration, device power, GPS and Bluetooth signal, permissions, internet access, Android background restrictions, battery optimization, Google/Firebase services, Wear OS pairing, and remote-device availability.
We do not guarantee that a device will be located, rung, protected, or recovered, or that alerts will arrive in time. Do not enter unsafe locations or confront another person based on information from the Service. Contact emergency services or local law enforcement where appropriate.
7. Purchases, trials, and subscriptions
- Purchases and subscriptions are processed by Google Play. The offer displayed before purchase controls the price, billing period, trial terms, and included features.
- A subscription automatically renews unless you cancel it through Google Play before the end of the current billing period. Google may charge the payment method associated with your Play account.
- A free trial, if offered, converts to a paid subscription unless cancelled before the trial ends. Availability and duration may vary by user and offer.
- You can manage or cancel a subscription at Google Play subscriptions. Uninstalling the app or deleting your MakeevApps account does not cancel a subscription.
- Refunds are governed by Google Play's rules and any mandatory consumer rights. MakeevApps does not receive or store your full payment-card details.
- Taxes, currency conversion, and price changes are handled as disclosed by Google Play. Any price change takes effect subject to the notice or consent required by Google Play and applicable law.
8. Privacy and device permissions
Our Privacy Policy explains how the Service handles data. Features may require location, background location, Bluetooth, notifications, overlay, settings, battery-optimization, or other Android permissions. You control these permissions in Android Settings, but disabling one may prevent the corresponding feature from working.
9. Third-party services
The Service depends on Google Play, Google Maps and location services, Firebase, Google Sign-In, Wear OS, device manufacturers, network providers, and other third-party systems. Their own terms and privacy policies apply to the services they provide. We are not responsible for third-party outages, account decisions, device restrictions, or changes outside our reasonable control.
10. Intellectual property
The Service, branding, designs, software, documentation, and original content are owned by MakeevApps or its licensors and are protected by intellectual-property laws. Open-source components remain subject to their respective licenses, listed in our Third-Party Notices. No right is granted except the limited license in Section 3.
If you voluntarily send suggestions, you grant MakeevApps a worldwide, perpetual, irrevocable, royalty-free right to use them without restriction or compensation, provided this does not transfer ownership of your personal data or confidential material.
11. Updates and changes to the Service
We may provide updates, change or discontinue features, introduce reasonable technical limits, or end support for operating-system or device versions. Some updates may be required for security or compatibility. We will provide notice of material changes where reasonably practicable or legally required. We do not promise permanent availability of any free feature.
12. Suspension, termination, and account deletion
You may stop using the Service at any time and may delete your account as described on the account deletion page. We may suspend or terminate access when reasonably necessary to address a serious or repeated breach, unlawful or harmful use, fraud, security risk, non-payment, or a legal requirement. Where appropriate, we will give notice and an opportunity to remedy the issue.
A physical device may be registered with more than one Service account. Deleting one account does not delete another account. However, server-stored location history and current device state for devices registered with the deleted account are removed and may also disappear from a remaining account until the active device uploads a new state. Messaging tokens may remain while needed to provide service messages to a remaining account, and limited technical logs may be retained temporarily as described in the Privacy Policy.
On termination, the license ends. Sections that by their nature should survive—including intellectual property, disclaimers, liability, indemnity, governing law, and accrued payment obligations—remain effective. Personal data is handled under the Privacy Policy.
13. Warranty disclaimer
To the maximum extent permitted by law, the Service is provided "as is" and "as available." MakeevApps disclaims implied warranties of merchantability, fitness for a particular purpose, accuracy, availability, non-infringement, and uninterrupted or error-free operation. Nothing in these Terms excludes warranties or remedies that mandatory consumer law requires.
14. Limitation of liability
To the maximum extent permitted by law, MakeevApps and its directors, employees, and contractors will not be liable for indirect, incidental, special, punitive, or consequential loss; loss of profits, data, opportunity, goodwill, or anticipated savings; failure to find or recover a device; harm resulting from inaccurate or delayed location; or third-party acts or outages.
To the maximum extent permitted by law, MakeevApps' aggregate liability arising from the Service will not exceed the total amount you paid to MakeevApps through Google Play for the Service during the 12 months before the event giving rise to the claim. Nothing in these Terms limits or excludes any liability, right, or remedy that cannot lawfully be limited or excluded.
15. Indemnity
To the extent permitted by applicable law, you agree to indemnify MakeevApps against third-party claims, losses, and reasonable costs resulting from your unlawful use of the Service, tracking without required authorization, infringement of another person's rights, or material breach of these Terms. This section does not apply where the claim was caused by MakeevApps or where consumer law prohibits such an obligation.
16. Governing law and disputes
These Terms are governed by the laws of the Czech Republic, excluding conflict-of-law rules. Courts in the Czech Republic have jurisdiction, except that a consumer may bring or defend proceedings in the courts of their habitual residence and retains any mandatory protections provided by the law of that country. Before filing a claim, the parties should try in good faith to resolve it by contacting each other. These Terms do not require arbitration or waive any right to participate in a lawful collective action.
17. General terms
These Terms and the Privacy Policy are the entire agreement about the Service, except for purchase terms shown by Google Play. If a provision is unenforceable, it will be limited to the minimum extent necessary and the remainder will continue. A delay in enforcing a right is not a waiver. You may not assign these Terms without our consent; subject to applicable law and any required third-party consents, we may assign them as part of a merger, reorganization, or transfer of the Service while preserving applicable consumer rights.
We may revise these Terms. Material changes will be communicated in the app or by another appropriate method where required. Continued use after the effective date constitutes acceptance only to the extent permitted by applicable law; if you do not accept a change, you may stop using the Service and delete your account.
